Does the FTC Have Authority Over Nonprofit Professional Associations?

A case now before the U.S. Supreme Court centers on this crucial question.

In its recent case before the U.S. Supreme Court, the California Dental Association presented two arguments—that the Federal Trade Commission does not have jurisdiction over nonprofit professional associations and that, even if it does, the cursory standard of review the FTC used to determine whether there was an antitrust violation was not proper. This, the first part of a two-part series, will focus on the jurisdictional argument. The second part of the argument will be reviewed in next month’s column.
